About the CC

What is the CC?

The CC is a new contract framework for the delivery of successful construction projects. Successful construction projects are likely if the numerous people involved with the project:-

  • work together as a team (and not as a group of highly skilled but disparate individuals) to achieve their collective ambitions for the project; and

  • collaboratively and pro-actively identify and manage the risks that threaten the achievement of these ambitions.

The contract has been over three years in development and has gone through extensive consultation with all sides of the industry, including a review by a number of the top construction law firms.

When do I use it?

The CC is intended for use by parties who genuinely want a contractual framework that assists a collaborative approach and seeks to identify and manage risks, rather than simply passing them under contract conditions and/or relying on "rule of thumb" risk contingencies as sole protection against the unexpected.

Why should I use it?

Quite simply because, if it is used in the correct spirit, its approach offers a far greater chance of successful projects than traditional forms of contract.

The CC comprises two principal elements:

  • The Purchase Order sets out the key elements of the contract. Once completed it is signed by both parties. Some sections may not be applicable and can be left blank or deleted. A number of appendices are also included providing prompts for the insertion of all additional information needed to enable relevant provisions of the CC to work such as risk allocation, payment provisions and specification.

  • The Collaborative Construction Terms support the processes necessary for successful projects and support the Purchase Order with a complete set of contractual provisions.

The CC also provides for a Project Protocol to be drawn up, expressing the personal aspirations of the Project Team members for the project and their ongoing relationships and how (in the broadest sense) this will be achieved.
